محور الكتاب هو نوازل الفقه المالكي، وقدصاغه المؤلف على طريقة السؤال والجواب ورتبه على أبواب الفقه بطريقة ميسرة: العبادات ثم المعاملات. يتميز بسهولة اﻷسلوب والدقة في العزو والنقل من المصادر، كما يتميز بالشمولية والاستيعاب ﻷغلب المسائل الفقهية. يسلط المؤلف الضوء على نوازل فقهية كثيرة في مسائل الاستفتاء والطهارة والوضوء ونواقضه والتيمم والمياه، وما إلى ذلك من الأبواب الفقهية التي تحتاج إلى مزيد اجتهاد مع مستجدات العصر، فالاجتهاد والبحث في أحكام النوازل له دوره الكبير في تجديد وتنمية الفقه في النفوس وفي واقع حياة الناس. ركز المؤلف في بحثه على استيفاء اﻹجابة على النازلة؛ فتارة يكتفي بإجابة عالم واحد وتارة يذكر إجابة آخرين عليها. ركز المؤلف أن يكون كتابه جامعا للنوازل في غير تطويل ممل ولا تقصير مخلّ. |
| Summary |
The book tackles Fiqh al-Nawāzil (contemporary issues jurisprudence) according to mālikī school. It is in question and answer form, lucidly written with high precision of authenticated references. Its chapters divided according to fiqh classification. The author comprehensively focuses on the contemporary issues in ṭahārā, wuḍūʾ and tayammum... Such issues that need iǧtihād (derivation of legal rules and principles from the detailed sources of Islamic law). Therefore, iǧtihād basically aims at finding feasible solutions to new issues, which have not been specifically addressed by the existing law, so as to give flexibility to Islamic law and to show its pragmatism.The book includes all contemporary issues with adequate details. |
